It isn't breaking hardcore news, but it's the first many have heard of a class-action lawsuit and settlement from 1995 that awarded over $1 billion dollars to homeowners affected by faulty plumbing pipe. The case (Cox vs. Shell Oil Company) was brought on behalf of homeowners with a certain type of pipe – known as polybutylene plumbing or PB pipe.

Homeowners who have the pipe installed in their homes could find themselves eligible to have leaky pipes replaced and be compensated for damage caused by the faulty plumbing. The notice of the lawsuit (the fourth since the settlement) has been popping up all over, but few eligible consumers are aware of their rights. Full details of the case can be found at www.pbpipe.com.

Only pipe of a certain type is covered in the lawsuit. This pipe has the following very distinctive characteristics:

• It is used in water supply systems, and is not used for drains, waste or vent piping.

• It is non-rigid (think bendy), sometimes curved, and is usually a grey-colored plastic.

• This pipe should not be confused with PVC or CPVC, which is usually white or cream-colored.

The pipe was widely used in homes where plumbing was installed between January 1, 1978 and July 31, 1995 (the dates affected by the recall). Homeowners who bought their homes after September 12, 2005 have the right to exclude themselves from the settlement (although by doing so they give up the right to be compensated for any damage caused by faulty PB pipe).

Boats and RV's with PB pipe are excluded from the settlement. Homeowners with PB piping who have NOT had a leak are not eligible. A “leak” is defined as having had to occur no sooner than one year from the date of installation, and it cannot have occurred as a result of abuse, abnormal wear and tear, natural disaster, or as part of an ice-maker line (I especially like this last one).

It's obvious from this FOURTH notification attempt that there are a large number of eligible homeowners who may be affected by this recall. Knowing about it is not common, as many people I spoke to had no clue. What's even more surprising is the number of homeowners who aren't even sure what kind of plumbing system they have. Since many updates to older homes may have involved several different types of piping, it is very possible that PB pipe has been used in a home of someone you know.

The best course of action is to inspect your plumbing for signs of leaks NOW, before the deadline of September 1, 2008 to file as a claimant. With a billion dollars set aside for the hassle of a defective product, I'm surprised there's not more coverage of this particular lawsuit. If you go ahead with the claim, be advised that they will probably send a contractor out to inspect damages and verify your eligibility. Once the process has begun, however, you can check the status of your claim online at the settlement website.

    My house was built in 1988 and has the grey pipes, over the years and as recent as 5-26-08 have experienced 4-5 leaks, all have been repaired. I did not know of the recall or the lawsuit until a friend told me yesterday. As I read the criteria, I question if I have waited too late to file a claim. Please advise.

    On May 29, 2008 we found a leak in the hot water heater PB gray pipe. The home was unoccupied at the time of the leakage, and damage was done to the carpet, pad, and sub flooring in living room and in the kitchen area, the laminate flooring which we just had installed last year, all will need to be replaced. Having just seen a report on TV regarding gray pipe, found this website. Are we eligible for the class action claim. Our home was built 1987.

    I live in a home with Gray Pipe, I and the previous owner have had several leaks and some damage. Only recently did I or the prior owner learn that their was a way to recover our loss etc. ?? How come it seems like the best kept Secret of the Century. Both I and the Bank had Professional Home Inspectors who did not mention it, we had plaumbers repair it that had the special tools req'd who didn't mention it, I have repaired leaks myself and discussed the problem with Home Depot Lowes etc. and nobody knew ????     we just bought a used 1991 double-wide mobile home and it has grey pipes. we had all new tile, carpet and laminate floors put in. yesterday in the bathroom the pipe to the toilet broke and water went every where. the tile in the bathroom and the laminate flooring in the hall and maybe dining room was soaked. It even got in our duct work about 5 in. deep. what can we do?

    I discovered I had a leak in my bathroom tub/shower faucet, which has the gray pipe, back in March/April of this year. I started having severe breathing problems which continue today. I removed the wall panel in my closet that contained the water pipes and discovered black mold caused by a leaky water pipe from the tub/shower faucet. I am still dealing with the leak. Plumbers cannot seem to get it fixed. My house is filled with a damp, musty, moldy smell which I am living in because I have no place else to go. I also found another leak in my second bathroom showe/tub faucet. No plumbers will work on it. The flooring is saturated and will need to be replaced. That means completely tearing out the tub to get to the flooring underneath. What a nightmare. Winter is coming soon in Minnesota and this needs to be fixed by September when I will have to close my windows and not be able to stand the air quality in my house. I need answers immediately. What do I do? I did take down the phone number and website that Jason supplied above. I will call this number to see what I can find out. If anyone knows of anything else I can do in the meantime, please let me know ASAP. I have taken pictures of the black mold in my closet wall. I have pictures of the saturated flooring in my second bathroom and some of the pipe connections that are leaking.

    They ask for "Plumbing repair receipts, work orders, photographs of the leak and/or repair and the actual failed part of the PB Plumbing System" So, when I had a leak last year, I should have known to take pictures, record the date and save receipts? And does everybody save every failed part, including every light bulb that blows? Well, we'll see what happens when I put in a claim here.

    I have noticed and fixed numerous leaks throughout my 1994 premier doublewide. I now have discovered that I have a substantial amount of black mold. Piping to the waterheater first broke. Then the plumbing to the shower which I didn't realize until it was to late. NOW I HAVE TO PULL UP MY FLOORING AND CARPET AGAIN. The grey plumbing in both bathrooms have had numerous leaks and my house has really begun to go downhill due to the constant laying and pulling of carpet and floors. Can I do anything to end this constant battle??????????

    If you have a leak in PB plumbing, you have to go to www.pbpipe.com and follow the instructions for filing a claim. We did that over 2 leaks spanning 2 years and we have just been approved for the no cost to us replumb process. This is scary, to say the least. No where in their work order form is a mention of who will do the job. There is no mention of a list of local plumbers to pick from. We live in Arizona. It looks like I turn my home's walls, tubs, sinks, tile, shower stalls, carpets, ceilings, basically everything over to them to replace with copper or pvc, our choice. WOW, this is really nerve racking. Has anyone been down this road ??????????????? Would love to hear your experiences !

    THESE BLOGS HAVE BEEN VERY HELPFUL. I OWNED A 1982 SOL. MOBILE HOME WITH GREY PIPE IT ALL STARTED LEAKING AROUND 1999. WHEN I CALLED THEY SAID IT HAD BEEN OVER 10 YEARS, SO IT WAS TO LATE.     I am, as well going through a living hell because of this pipe. I have a 1976 taylor mobile home with this pipe. We have fixed over 10 leaks within the year and we just had the pipe to one of our bathroom sinks break last week. The shower in one of our baths don't even work! We have had to replace the bathroom floor, kitchen, livingroom, and the bedroom already......pretty much all of the house, and still having leaks. It is like no faster we fix one we have another. It is ridiculous. Not to mention I have a 4 month old and I am terrified of mold accumilating under the house and making her or us sick. Does anyone know if I would qualify and who to contact if so?     I have a 1983 Liberty Mobile home. The entire home is equiped with the gray pipe. Someone told me about the recall before, but also said it was too late to do anything about it. I have had numerous leaks throughout the entire home. The leaks have been fixed, but now I have quite a bit of floor damage due to the leaks. Is it now to late to do anything about replacement of the pipe through the manufacturer. It would be quite expensive to redo the whole house. Is there any advise you may have.

    I just had two leaks, one involved the water supply line going to the toilet, it was not a big leak, more like a misty leak, and two days later the same type of leak happened on the water supply line for the washer machine. I found this out when the carpet in my bedroom was soaked. Of course the floor is warped now. This is frustrating.

    I just found out about this lawsuit today, August 29, 2009. I have had a leak in my home for over 1 1/2 perhaps. I thought it was the air conditioner. It was a small leak so I put off fixing it. About 2 weeks ago, water begin leaking into my dining room, and in my garage. It is bad. The wall has mildew on it, and the base board is rottening. The plumber informed me today that there is a lawsuit concerning this matter. I recently found out that one cut off date is May 09.     I just found out about the recall from a man in the mobile home park where I reside. I had a leak under the sink in the bathroom and the water flooded the carpet in the eating area of the kitchen. I too appear to have missed the deadline but I question what efforts were made to notify all people who might be elligible to have repairs made. i am a "news" junkie and seldom miss the am news or the 6pm news. I never heard anything about it in spite of spending 5-6 months in FL since 2004. If a good faith effort was not made would there be any way of reopenning this case---particularly if the money alloted was not spent.

    I bought my get away from a company in Hothorn Fla. From a dealer, his name Don his number is 386 684-3933. He never said anything about a lawsuit on gray pipe in mobile homes. He is the owner of the moble home place and he told me that I was getting a great mobile home. Do not use this ompany .I had no idea that I had grey pipe until I had a plummer come out this year. He told me about the law suit. I was finally able to get to this site and I find out that it is too late. Now they want $3,800.00 to fix all of my pipes.     Isn't there a requirement for lawsuits such as these that homeowners be notified of this, just like recalls on batteries, etc. I just had my first leak in my 1992 built home in Woodbridge VA and found out from my plumber who mentioned it as soon as he saw the pipes. If may homeowners are not aware, then there is definitely millions of dollars still left in the settlement ($1 billion) that are unclaimed because we were never notified. There should be another class-action to address this.

    I suspect my parents own a manufactured home with this plumbing. They not only have had to replace the plumbing, but just about every floor space and some dry wall areas from the damage. Right now, the floors are all very wet and very moldy - they are looking at a VERY costly clean up. How can we pursue this issue - can they file a lawsuit now (1/2010)?     I have just been suit for a leak occuring behind my wall in my condominium. My insurance company advised that I was not liable due to lack of negligence. After pursuing the suit, and my insurance company obtaining a copy of my homeowners' association's bylaws, they determined that I was negligent simply because I have this type of plumbing. The bylaws state that the condo owner is responsible for any plumbing that serves only that unit, even though the plumbing is behind the boundaries of ownership (drywall). I now, because of these pipes, own a condo that I cannot sell, cannot insure, and cannot repair. Technically, the plumbing that serves only my unit travels THROUGH my neighbor's wall and floors, so it would be impossible (let alone illegal) for me to replace them. Obviously, there are many of us with this type of plumbing who did not benefit from Cox vs. Shell; we need to re-file this class action suit, but I'm not sure how to go about it. Thoughts?

I have only now heard of this issue - had a home inspection done at the time of purchase and was never told about this issue. The latest leak occured over the weekend and was not noticed for a couple of days - carpets now have to be replaced, etc. Did / does this lawsuit include Canada, is it too late for me to join?

    Have a trailor that we bought in 2000. We just discovered that we have the grey pipes. Have had many leaks in the past. We live in a trailor park that has its own well. DNR required the well be tested well pasted inspection and all the other trailors in the court also pasted. But our trailor had failed all 5 times it was tested.     I bought my home a year ago, it was originally manufactured in 1989, and we have had many many problems, I'm currently waiting for the plumber. I don't think it's fair for them to close the case if the piping has been recalled. Someone needs to do something. We were just informed of this when a plumber was out last week. And from the leaks, my floors and walls will have to be replaced as well, and we have 3 young children! I am sending this to a local news agency to see if we can get it some attention and maybe they will help us, after all, its not our fault they made them with crappy plumbing, and now we have to pay to fix it???

I made some call and was told that the recall was over. every since the first problem with the gray pipes i have had serval problems and i have to pay this 300 to 400 dollaras everytime this happens. and this is still going on.
